Exercising State Privacy Rights
Automated Decision-Making and Profiling
Certain mortgage loan decisions may involve automated underwriting systems (AUS) provided by government-sponsored enterprises (such as Fannie Mae’s Desktop Underwriter or Freddie Mac’s Loan Product Advisor) or other mortgage technology platforms. These automated systems analyze financial information from your application - including credit, income, assets, and property characteristics - to produce an underwriting recommendation.
Automated underwriting recommendations do not constitute a final credit decision. Final loan approval decisions are reviewed by licensed mortgage professionals and are subject to human review, investor guidelines, and applicable underwriting requirements.
Residents of Colorado, Connecticut, Montana, Oregon, and certain other states may have the right to opt out of profiling used to make decisions that produce legal or similarly significant effects. If you wish to exercise this right, contact us using the information in the Contact section. Please note that opting out of automated mortgage underwriting may affect our ability to process certain loan programs.
Artificial Intelligence and Machine Learning
We may use artificial intelligence (AI) and machine learning (ML) tools to support certain business functions, including website analytics, customer communication tools, and internal process improvements. We do not currently use AI or ML systems to make final mortgage credit decisions; any such tools produce recommendations subject to human review.
Where personal information may be used in connection with AI or ML tools operated by third-party service providers, those providers are required to handle information in accordance with applicable privacy laws and our contractual requirements. We do not permit third-party AI providers to use your personal information to train general-purpose AI models without appropriate contractual protections.
Data Breach and Security Incident Notification
In the event of a security incident involving unauthorized access to or disclosure of personal information that triggers notification obligations under applicable federal or state law, we will notify affected individuals within the timeframes required by law.
Notifications will be provided by email (to the address on file with us), by mail, or by other methods permitted by applicable law. Where required, we will also notify appropriate state regulatory authorities, consumer reporting agencies, or other parties as mandated.
If you believe your personal information held by us may have been subject to unauthorized access, please contact us immediately at greg@hfmloans.com or +1 (636) 256-5710.
